Scars to Glow – Terms of Use

Scars to Glow is a mobile game created by Healing Mates Digital Inc. (“Healing Mates”, “we”, “us”, “our”), a corporation based in Ontario, Canada. These Terms of Use (“Terms”) form a legal agreement between you and Healing Mates and govern your use of the Scars to Glow mobile game and any related features, content, or services (collectively, the “Game”).

By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.

1. Eligibility and Age

  • The Game is intended for users aged 13 years or older.
  • If you are between 13 and the age of majority where you live, you should only use the Game with permission of a parent or legal guardian.
  • Parents or legal guardians who believe the Game is not suitable for their child, or that their child is using the Game in a way they do not approve of, may contact us using the details in Section 13.

2. License and Ownership

2.1 Limited License

Subject to your continued compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Game on a device you own or control, solely for non-commercial entertainment.

2.2 Reservation of Rights

You acknowledge that all rights, title, and interest in and to the Game (including all artwork, graphics, text, sounds, code, and other content) remain with Healing Mates and its licensors. No ownership rights are transferred to you.

2.3 Restrictions

You agree that you will not:

  • Copy, modify, distribute, sell, lease, or sublicense any part of the Game.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Game, except where such restrictions are prohibited by law.
  • Use the Game for advertising, promotion, or other commercial purposes without our prior written permission.

Any rights not expressly granted in these Terms are reserved by Healing Mates and its licensors.

3. Acceptable Use and Prohibited Conduct

You agree to use the Game in a lawful, fair, and reasonable manner. You must not:

  • Interfere with, disrupt, or overload the Game or any related systems or networks.
  • Introduce viruses, malware, or other harmful code.
  • Use bots, scripts, hacks, cheats, or other unauthorized tools or automation to gain an advantage or manipulate gameplay, scores, or ads.
  • Circumvent any security or technical protection in or around the Game.
  • Use the Game to violate any applicable law or any third-party rights.

We may monitor general usage (for example, crash logs and anonymous gameplay patterns) to keep the Game functional and secure, as described in the Scars to Glow Privacy Policy.

4. In-App Purchases and Fees

  • Scars to Glow is currently free to play and supported by advertising. If we introduce optional in-app purchases or paid upgrades in the future, any purchase will be processed by your app store (such as the Apple App Store or Google Play Store).
  • We do not receive or store your payment card numbers; all payment details are handled solely by the app store under their own terms and privacy policy.
  • Unless required by applicable law or the app store’s own policies, all purchases are final and non-refundable.

5. Advertising and Third-Party Services

5.1 Advertising

The Game uses third-party advertising networks (such as Google AdMob) to display ads. These services may process certain device and usage information to show, measure, and improve ads, and to help prevent fraud and abuse. For more details, please see the Scars to Glow Privacy Policy and the privacy policies of the advertising partners.

5.2 Third-Party Content and Links

Ads or links displayed in the Game may lead to third-party apps, websites, or services that we do not control. We are not responsible for:

  • The content, products, or services offered by any third party; or
  • Any losses or issues arising from your dealings with third-party sites, apps, or services.

Your use of third-party services is governed by their own terms of use and privacy policies.

6. Game Updates and Availability

  • We may update, modify, or improve the Game from time to time, for example to fix bugs, improve performance, or adjust gameplay.
  • We may add, change, or remove features or modes at any time, without obligation to you and without prior notice.
  • We may suspend or discontinue the Game entirely (temporarily or permanently) at any time.

We do not guarantee that any particular feature, mode, or high score will remain available or preserved.

7. Intellectual Property

All trademarks, logos, service marks, artwork, designs, animations, sounds, and other content appearing in or related to the Game are the property of Healing Mates or its licensors and are protected by applicable laws and international treaties.

You may not use our trademarks or logos without our prior written consent, except as allowed by law (for example, fair use).

8. Disclaimer of Warranties

The Game is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we:

  • Do not make any warranties or representations, express or implied, about the Game, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.
  • Do not guarantee that the Game will be uninterrupted, secure, or error-free, or that any defects will be corrected.

You use the Game entirely at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Healing Mates, its directors, officers, employees, contractors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or other intangible losses arising out of or in connection with your use of (or inability to use) the Game.
  • Our total cumulative liability for any claim relating to the Game or these Terms shall not exceed the greater of:
    • The amount you paid directly to us (if any) for use of the Game during the three (3) months preceding the event giving rise to the claim; or
    • CAD $10.

Some jurisdictions do not allow certain limitations of liability. In those cases, the above limitations apply only to the extent permitted by local law.

10. Indemnification

You agree to indemnify and hold harmless Healing Mates, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Game;
  • Your violation of these Terms; or
  • Your violation of any applicable law or third-party right.

11. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government action, labor disputes, internet or telecommunications failures, third-party service interruptions, or other similar events.

12. Termination

  • You may stop using the Game and uninstall it at any time.
  • We may suspend or terminate your access to the Game, or withdraw the Game entirely, at any time and for any reason, including if we reasonably believe that you have violated these Terms.

Provisions of these Terms that by their nature should survive termination (including but not limited to ownership, disclaimers, limitation of liability, and governing law) shall continue in full force and effect.

13. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-law principles.
  • Any dispute, claim, or controversy arising out of or relating to these Terms or the Game shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless mandatory consumer protection laws in your country require a different venue.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” at the top. We may also provide notice within the Game or on our website.

If you continue to use the Game after updated Terms take effect, you will be deemed to have accepted the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be applied to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
