Guinea Pig Chess is a mobile game created by Healing Mates Digital Inc. (“Healing Mates”, “we”, “us”, “our”), a corporation based in Ontario, Canada. These Terms of Use (“Terms”) form a legally binding agreement between you and Healing Mates and govern your access to and use of the Guinea Pig Chess mobile game and any related features, content, or services (collectively, the “Game”).

By downloading, installing, accessing, or playing the Game, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Game.

1. Eligibility and Age

  • The Game is intended for users aged 13 years or older.
  • If you are between 13 and the age of majority in your jurisdiction, you may only use the Game with the consent of a parent or legal guardian.
  • Parents or legal guardians who believe the Game is not suitable for a child may contact us using the details in Section 16.

2. License and Ownership

2.1 Limited License

Subject to your ongoing compliance with these Terms, Healing Mates grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the Game on a device you own or control, solely for non-commercial entertainment purposes.

2.2 Ownership and Reservation of Rights

All rights, title, and interest in and to the Game — including but not limited to all artwork, characters, animations, sounds, music, designs, rules, mechanics, text, code, and overall “look and feel” — are owned exclusively by Healing Mates or its licensors.

No ownership rights are transferred to you. Any rights not expressly granted in these Terms are reserved by Healing Mates.

2.3 Restrictions

You agree that you will not:

  • Copy, modify, distribute, sell, lease, sublicense, or exploit any part of the Game.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code, except to the extent such restrictions are prohibited by law.
  • Use the Game or its content for advertising, promotion, commercial gain, or public performance without our prior written permission.

3. Acceptable Use and Prohibited Conduct

You agree to use the Game in a lawful, fair, and reasonable manner. You must not:

  • Interfere with, disrupt, overload, or attempt to damage the Game or its systems.
  • Introduce viruses, malware, exploits, or other harmful or destructive code.
  • Use bots, scripts, hacks, cheats, automation, or unauthorized tools to manipulate gameplay, progression, rewards, or advertisements.
  • Circumvent or attempt to bypass technical protections or safeguards.
  • Use the Game to violate any applicable law or third-party right.

4. Advertising, Rewards, and Virtual Items

  • The Game is free to play and supported by advertising, including banner, interstitial, and optional rewarded ads.
  • Viewing rewarded ads is optional and may unlock cosmetic or progression-based virtual items with no real-world value.
  • All progress, points, and unlocks are stored locally on your device.
  • If you delete the Game, clear its data, or change devices, progress and unlocks may be permanently lost and cannot be restored.

5. No Monetary Value; No Refunds

Virtual items, points, or rewards in the Game have no monetary value, are not redeemable for cash, and may not be transferred or sold.

Except where required by applicable law or app store policies, all purchases (if introduced in the future) are final and non-refundable.

6. Third-Party Services and Content

The Game uses third-party services such as Google AdMob to display advertisements. These services may collect and process certain device or usage data in accordance with their own privacy policies.

We do not control and are not responsible for third-party content, services, websites, or applications accessed through ads or links in the Game.

7. Game Updates, Changes, and Availability

  • We may update, modify, rebalance, or improve the Game at any time.
  • We may add, change, or remove features, mechanics, characters, or content without notice.
  • We may suspend or discontinue the Game, in whole or in part, at any time, temporarily or permanently.

We do not guarantee that any feature, content, score, or progression will be preserved.

8. Disclaimer of Warranties

The Game is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Healing Mates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, profits, revenue, or goodwill.
  • Our total cumulative liability for any claim related to the Game or these Terms shall not exceed the greater of:
    • The amount you paid directly to us in the three (3) months before the claim; or
    • CAD $10.

10. Indemnification

You agree to indemnify and hold harmless Healing Mates, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Game;
  • Your violation of these Terms; or
  • Your violation of any applicable law or third-party rights.

11. Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, internet outages, platform failures, labor disputes, or government actions.

12. Termination

  • You may stop using and uninstall the Game at any time.
  • We may suspend or terminate access to the Game at any time if we reasonably believe you have violated these Terms.

Sections relating to ownership, disclaimers, limitation of liability, indemnification, and governing law survive termination.

13. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles.
  • Any dispute shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless mandatory consumer protection laws require otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will be updated accordingly. Continued use of the Game after changes take effect constitutes acceptance.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
